(A) Within 30 days after the receipt of a completed application, the Town Council shall either issue a permit or issue a written denial of a permit to the applicant.
(B) The Town Council or its designee shall approve the application and grant a sexually oriented business permit unless one or more of the following is true:
(1) An applicant is less than 18 years of age;
(2) An applicant has failed to provide information required by § 112.36 or has provided false information on the application;
(3) The premises to be used for the sexually oriented business are not in compliance with the locational requirements of § 112.15;
(4) The applicant failed to pay the nonrefundable permit application fee; or
(5) The applicant has a permit under this chapter that has been revoked within the previous year.
(C) The granting of a permit to a permittee for a sexually oriented business shall be for one year and is non-transferable to any other person other than the applicant(s) listed on the application and is valid only for the location listed on the application.
