§ 111.073 UNDERGROUNDING.
   (A)   Except as hereinafter provided, in all areas of the town where the cables, wires, and all other like facilities of a municipal or public utility are placed underground, each grantee shall construct and install its cables, wires, and other facilities underground. Amplifier boxes and pedestal-mounted terminal boxes may be placed above ground if existing technology reasonably requires, but shall be of a size, design, and location so as not to be unsightly or unsafe. In any area of the town where there are certain cables, wires, and other like facilities of a municipal or public utility underground and at least one operable cable, wire, or like facility of a municipal or public utility suspended above the ground from poles, a grantee may construct and install its cables, wires, and other facilities from the same pole.
   (B)   With respect to any cables, wires, and other like facilities constructed and installed by a grantee above ground, the grantee shall, at its sole expense, reconstruct and reinstall the cables, wires, or other facilities underground pursuant to any project under which the cables, wires, or other like facilities of the municipal or public utilities are placed underground within an area. The duty of a grantee to place its cables, wire, and other facilities underground shall arise only if all like facilities or utilities which are existing above ground are placed underground.
