In making a determination whether to award a franchise, the Town Council may consider the following factors:
(A) The quality of service which the applicant promises and of which the applicant is capable;
(B) The income and expense to the town government;
(C) The needs of other users of the public ways;
(D) The capacity of the public ways and private property, including easements, poles, and conduits, to accommodate the additional equipment or other demands of an additional cable operator;
(E) The effect on the ability of existing grantees to perform their obligations under their franchises;
(F) The experience, character, background, and financial responsibility of the applicant;
(G) The demonstrated ability of the applicant to meet the construction schedule in the application and any physical requirements imposed by this chapter;
(H) The likelihood that the applicant, as a cable operator, can maintain financially feasible operations over an extended period of time; and/or
(I) Any other considerations deemed pertinent by the Town Council to its task of safeguarding the public health, safety, and welfare, and facilitating and encouraging the orderly and responsible development of a cable system which will provide the people of the town with cable service which is versatile, reliable, and efficient.
