The Town Council reserves the right to award franchises on terms and conditions that may deviate from the terms and conditions of this chapter. This shall be permitted where the Town Council expressly determines that special circumstances warrant the deviations. A cable operator’s use of technology or equipment affecting the public interest or public resources in substantially different ways than this chapter was designed to address may entail special circumstances.
