(A) Animal shelter. The physical facility known as the town animal shelter shall be under the control of the Town Council. The Town Council shall retain all powers and duties conferred by this chapter for the detailed supervision of matters relating to animal control. It is the intent of this chapter that the Town Council be the body to formulate, adopt, and implement policies, principles, and standards for humane treatment and control of all animals in the town.
(B) Adoption fees.
(1) The fee to adopt any animal shall be as listed in this section. The adoption fee must be paid prior to the animal being taken to his or her new home.

(2) In order to help more companion animals find suitable homes, the Clerk-Treasurer has the discretion to lower the adoption fees under the following circumstances:
(a) Adoptions of animals which have incurred extraordinary expenses while under the shelter’s care;
(b) Adoptions of hard-to-adopt animals or of foster animals by foster parents;
(c) Adoptions by breed rescue organizations or transfers to humane associations; or
(d) Adoptions through special promotions or when the kennel is full.
(3) The Clerk-Treasurer shall inform the Town Council of any such adjustments at its next scheduled meeting.
