(A) Any person who violates any provision of this chapter shall be deemed guilty of a violation and upon conviction, shall be fined pursuant to the following schedule:
(1) First offense in a one-year period: $50; and
(2) Second offense in a one-year period: $100.
(B) Each day that a violation occurs constitutes a separate offense.
(C) The certificate of registration for any off-road vehicle issued under the provisions of § 73.07 of this chapter shall be revoked upon the commission of a second violation of this chapter within any one-year period.
(D) In the event it is necessary to file suit to enforce the provisions of this chapter, the town is entitled to recover attorney fees and related court costs from the violator.
(E) All penalties assessed for violation of this chapter shall be deposited into the General Fund of the town and be made available for appropriation to the operating budget of the Police Department.
