For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OFF-ROAD VEHICLE. An all-terrain vehicle as that term is defined in I.C. 14-8-2-5.7 (except that all-terrain vehicles designed for travel on three non-highway or off-highway tires shall be excluded from this definition for the purposes of this chapter) and a recreational off-road vehicle as that term is defined in I.C. 14-8-2-233.5. The term OFF-ROAD VEHICLE for the purposes of this chapter does not mean a multi-wheel drive or low pressure tire vehicle; an amphibious vehicle; a ground effect air cushion vehicle; a farm vehicle; a vehicle used for military or law enforcement purposes; a construction, mining, or industrial related vehicle; a snowmobile; a registered aircraft; a golf cart vehicle; any other vehicle properly registered by the State Bureau of Motor Vehicles; and any water craft that is registered under the state statutes.
OPERATOR. An operator of an off-road vehicle must be at least 18 years of age and possess a valid motor vehicle driver’s license as is also required by I.C. 14-16-1-20(C).
ORV STREETS. All town streets inside of the town limits, except restricted streets.
RESTRICTED STREETS.
(1) State Highways 50, 135, and 250, except as provided in division (3)(c) below.
(2) Any street or highway posted by order of the town or its designee for non-use by off-road vehicles.
(3) Any of the following:
(a) On sidewalks;
(b) On the County Pathway/Trail;
(c) On State Highways 50, 135, and 250, except to cross said State Highways 50, 135, and 250, at intersections in a path 90 degrees to the state highway.
1. The operator shall bring the off-road vehicle to a complete stop before proceeding across a state highway and shall yield the right-of-way to all traffic.
2. However, off-road vehicles may be operated on State Highways 50, 135, and 250, in connection with and during the course of such special events as may be from time to time determined and so designated by the Town Council.
(d) On the following streets during times that school buses are visibly operating on the street or on the premises of Brownstown Central High School, Brownstown Middle School, and Brownstown Elementary School:
1. Bridge Street;
2. Walnut Street; and
3. Base Road south of Commerce Street.
(e) On any surface, whether paved or unpaved, of property belonging to the Brownstown Community School Corporation;
(f) On any unpaved surfaces of public property; and
(g) On any private property without permission of the owner.
