(A) The Brownsburg Park Board is hereby reorganized and restructured under Indiana law with the Brownsburg Town Council serving as the “Park Authority” as defined by I.C. 36-10-5-2(b)(1). Consequently, the members of the municipal legislative body of Brownsburg shall hereafter serve as members of the Brownsburg Park Board.
(B) All other membership on the Brownsburg Park Board, other than the members of the municipal legislative body, is therefore dismissed, and all authority of the Brownsburg Park Board shall be transferred and invested in the members as restructured by this section.
(C) The Brownsburg Park Board, as restructured hereunder, may establish, aid, maintain and operate public parks, playgrounds, and recreation facilities and programs, as permitted by Indiana law.
(D) The Brownsburg Park Board, may, from time to time, establish advisory committees interested in the town, public parks, playgrounds, recreational facilities, programs and properties, having authority and responsibility as directed by the Brownsburg Park Board.
(E) As the Brownsburg Park Board, the Brownsburg Town Council shall have all of the powers and duties prescribed by Indiana law.
(F) It is the intent of Brownsburg that this section and the acts within do not abrogate or alter the prior or currently applicable rules and regulations relating to the Brownsburg Parks Department, subject only to the transfer of functions attendant to the restructuring of the Brownsburg Park Board as set forth herein. To that end, all prior rules and regulations of the Brownsburg Park Board are ratified and reaffirmed until such other as the reconstituted Brownsburg Park Board determines otherwise. All prior ordinances or resolutions that are in conflict with the restructuring of the Brownsburg Park Board as set forth in this section are hereby superseded to the extent in conflict herewith.
(G) All contracts or agreements where the Brownsburg Park Board is a party therein that are currently effective, ongoing, or in place will continue in full force and effect, with all Brownsburg Park Board obligations being met.
