§ 40.13 POLICE DEPARTMENT TRAINING FACILITY FEE SCHEDULE.
   The Police Chief shall publish a schedule of use and charges fees as authorized by this section for the use of the Training Facility. All fees and charges collected shall be deposited in the Brownsburg Police Department Training Facility Maintenance Fund, and an accounting of such funds shall be made on monthly expense reports from the Clerk Treasurer's office. All monies in the fund shall be subject to the applicable laws regarding the accounting of public funds. The fee and charge schedule may be reviewed each calendar year with any changes in the fee and charge schedule being implemented if approved by an amendment to this section.
   (A)   Reservation for Training Facility use. Upon submittal of all required documentation by a requesting agency, the Training Coordinator will review the documentation and forward it with a recommendation to any Executive Staff member for approval/disapproval.
      (1)   The invoice for the use of the Training Facility must be paid in full by the using agency within thirty (30) days following the agency's use of the Training Facility. The method of payment is check. An agency's reservation for use of the Training Facility will be confirmed upon receipt of the agency's purchase order.
      (2)   Each using agency shall designate an individual (responsible party) who will complete the scheduling and registration process. The responsible party must be in a position to bind the agency to a contract. A copy of the agency's general public liability insurance certificate is required to be delivered to the Police Department prior to Training Facility use. The certificate of insurance shall designate the Brownsburg Police Department and Town of Brownsburg as additional insureds.
      (3)   A certified Indiana Law Enforcement Academy Firearms Instructor will supervise all firearms activities conducted at the Training Facility. All training exercises conducted at the Training Facility will be pre-approved by the Police Department (Training Coordinator) or members of the Police Executive Staff.
      (4)   Firearms instructor(s) will be required to attend a short training session on the use of the Facility equipment prior to the training activity. All personnel using the Facility will be required to be in an on-duty status and covered by their agency's insurance.
      (5)   Weapons brought into the Training Facility must be unloaded. The only exception will be full-time officers on duty. All weapons will remain holstered until directed otherwise by the Range Master and/or Safety Officer.
      (6)   Agencies utilizing the Training Facility will be responsible for clean up and the return of the training area to its condition prior to the training. Any agency that fails to do so will be charged an additional one-day fee. The Training Coordinator or members of the Executive Staff will conduct a pre- and post- inspection of the Training Facility.
      (7)   Damage to the Training Facility or equipment will immediately be reported to one of the listed Police Department personnel. Damage incurred due to misuse or negligence will be cause for suspension from the facility. Using agencies will be liable for any damage to the facility or equipment.
      (8)   Horseplay will not be tolerated and will result in immediate eviction of the offending party from the Training Facility while remaining liable for payment of all applicable fees and charges.
   (B)   Room rental fees and rules/regulations.
      (1)   Indoor Range/Control Room.

         (Four (4) hours or less with a minimum fee of $50 if use is less than two (2) hours).
         (a)   Includes use of training room, if requested. Size of the training room is at the discretion of Police Department as necessary for the number of personnel attending.
         (b)   Ammunition used in the Training Facility will be lead-free/non-toxic and pre-approved by the Training Coordinator or members of the Police Executive Staff.
         (c)   The using agency's firearms instructor(s) is responsible for insuring that all personnel using the indoor range follow the rules and regulations established and provided by the Training Coordinator or members of the Executive Staff.
      (2)   Multi-Purpose Area/Utility Bay.

         (a)   Includes use of a training room, if requested. Size of the training room is at the discretion of Police Department as necessary for the number of attending personnel.
         (b)   A certified Simunition Safety Officer or equivalent will oversee all simunition or paintball training. The Safety Officer is responsible for securing the training area and equipment to be utilized. The Safety Officer is responsible for making sure all personnel in attendance wear the proper safety equipment. No live ammunition or weapons are to be brought into the training area. Only approved simunition or paintball ammunition will be used.
         (c)   The large mats are to be cleaned before and after use. Only gym shoes are to be worn on mats.
      (3)   Training Rooms.
         (a)    Large Classroom.

         (b)   Small Classroom. (Twelve (12) persons or less).

         (Four (4) hours or less with a minimum fee of $50 if use is less than two (2) hours).
         (c)   Agencies utilizing the training rooms only shall not permit personnel to roam the Training Facility outside the designated areas. (Use of the training rooms does not authorize access to the upstairs or range area).
      (4)   Police Department representative. A Police Department designee will be available at all times during the use of the Training Facility. The charge for the designee will be in effect only during non-business hours and will be added to the total use fee and charge at the time the use of the Training Facility is requested. The designee will advise or answer questions to make certain the building and those personnel using it remain secure. The designee fee and charge is twenty-five dollars ($25) per hour.
      (5)   Facility fee waiver. The Executive Staff may approve a waiver of Training Facility fees and charges pursuant to a written mutual aid agreement between the Police Department and an agency providing for exchange of training facility use or training services. Use privileges or training services exchanged should be comparable training facility use or training services approved by the Police Department.
