(A) Title. This ordinance, and all ordinances supplemental or amendatory hereto, shall be known as the "Key Box, Data Storage Box and Fire Department Security Cap Ordinance."
(B) Purpose. The purpose and intent of this ordinance is to prescribe requirements for the installation of key boxes, data storage boxes and/or fire department security caps.
(C) When required - new construction. The Brownsburg Fire Territory array determine that a key box, data storage box emergency access system, and/or fire department connection security cap compatible with the system currently being utilized by the Brownsburg Fire Territory, is necessary and required if:
(1) The building is protected with an automatic sprinkler system equipped with a local or transmitted water flow alarm; or
(2) The building is provided with any fire alarm system equipped with an outside audible/visual signaling device; or
(3) The building is provided with any fire alarm system where the alarm is transmitted to an off-site location, or to the fire alarm center for the servicing fire department; or
(4) Any building where the owner, owners, tenants or agents of either have requested that the Brownsburg Fire Territory hold keys or maintain information on the building to utilize in emergency situations; or
(5) The building is provided with a sprinkler system, standpipe system, and/or any other fire suppression system.
(D) When required - existing buildings.
(1) The Brownsburg Fire Territory shall review and may require, key boxes and/or data storage boxes for existing buildings if any of the following circumstances are met:
(a) A change of occupancy requiring a construction design release by the State of Indiana; or
(b) Remodeling that requires the issuance of a building permit by the Town of Brownsburg or Hendricks County; or
(c) Any building where the owner, owners, tenants, or agents of either, cannot be expected to be available on site within five minutes of any alarm sounding or emergency occurring at the building site; and
(2) One of the following conditions exist:
(a) The building is protected with an automatic sprinkler system equipped with a local or transmitted water-flow alarm, the building is protected with a standpipe system, has any type of fire suppression system; or
(b) The building is provided with any fire alarm system equipped with an outside audible/visual signaling device; or
(c) The building is provided with any fire alarm system where the alarm is transmitted to an off-site location, or to the fire alarm center for the servicing fire department; or
(d) Any building where the owner, owners, tenants or agents of either have requested that the Brownsburg Fire Territory hold keys or maintain information on the building to utilize in emergency situations.
(3) Such key boxes/ data storage boxes shall contain the following:
(a) Keys to locked points of ingress/egress whether on the interior or exterior of such buildings.
(b) The keys to locked mechanical rooms.
(c) The keys to locked electrical rooms.
(d) Keys to elevator controls and control rooms.
(e) Keys to other areas as directed by the Brownsburg Fire Marshal and/or Fire Chief.
(f) Information Data Sheets, MSDS sheets or other pertinent information deemed necessary.
(E) Location.
(1) The key box and/or data storage box shall be installed at a location, on the building, approved by the Brownsburg Fire Marshal and/or Fire Chief.
(2) The fire department security caps shall be installed on all sprinkler system/standpipe fire department connection points, when the Brownsburg Fire Marshal and/or fire chief approves location. of said connections.
(F) Applications. The Brownsburg Fire Territory shall provide applications for key boxes, data storage boxes and/or security caps.
(G) Responsibility for key boxes, data storage boxes and/or security caps. The acquisition, installation and maintenance of key boxes, data storage boxes and/or security caps is the joint responsibility of the owners and tenants of buildings, and the failure of any owner or tenant to fulfill their responsibility does not relieve the other of the responsibility. Up to two tenants of a multi-tenant building may share one owner-provided key box and the building owner shall assume the responsibility for insuring that keys are updated as appropriate for each tenant space. Tenant provided boxes may riot be shared lay another tenant and the tenant assumes responsibility for key updates for the subject tenant space. Key boxes, data storage boxes and/or fire department security caps shad be installed and operational prior to certificate of occupancy being issued.
