(A) Recreational credits for automotive racing events. A recreational credit for up to a seventy-five percent (75%) credit for the annual storm water user fees is available for qualifying property determined to be eligible by the Town, so long as the following conditions are met by the applicable property owner, and such other reasonable conditions that may be adopted by the Town from time to time:
(1) The ratio of the pervious vs. impervious surface on the property is maintained at a ratio so that the impervious surface area does not exceed thirty-five percent (35%) of the entire property;
(2) The primary use of the property must be for recreational-type purposes, including automotive racing support activities, racing events and camping activities associated therewith;
(3) The property must be owned by a not-for-profit organization under applicable laws, and must have a minimum capacity to accommodate twenty-five thousand (25,000) attendees or more at each event; and
(4) The property owner must successfully complete any application process required by the Town to demonstrate compliance with this section.
(B) Recreational land use credit. A seventy-five percent (75%) credit for monthly user fees may be granted for a property where the primary function is for recreational purposes. Recreational functions may include, but are not limited to. the following: parks, soccer fields, football fields, golf courses, camping areas, trails, hiking and common areas. The property must have seventy percent (70%) pervious area or more (30% impervious or less) as compared to the entire parcel area. Impervious areas must flow to a pervious area where infiltration into the ground can occur. An individual property qualifying for this credit may not be issued more than seventy-five percent (75%) credit for the property.
(C) Credits for trails or access drives. Trails or access drives that are surrounded by pervious areas may be eligible for user fee credits on those properties. One hundred percent (100%) credit may be granted for parcels that contain only trails or access drives, when a qualifying vegetated filter strip collects runoff from the trail or access drive. The filter strip shall meet the following criteria:
(1) The filtering distance of the filter strip must be at least as wide as the trail or access drive, and requires a minimum slope of one percent (1%) and maximum slope of five percent (5%) for the slope of the filter strip.
(2) The filter strip must be maintained with vegetation cover at a density of eighty percent (80%) or greater over the soil surface, and a minimum vegetation height of four (4) to six (6) inches. Deep rooting vegetation is preferred to prevent eroding of the vegetation and to promote infiltration into the ground.
