§ 54.30 VIOLATIONS FOR METER TAMPERING.
   (A)   No person is permitted to open, enter into, or tamper with any metering equipment of the Town’s water utility without the specific authorization of the Water Utility Superintendent or any one designated by the Superintendent. Any person found to have violated this provision shall be subject to a mandatory fine of three hundred dollars ($300) per occurrence. To these fines, the Town Court Judge, or Hendricks County Court Judge, may add additional fines not to exceed three hundred dollars ($300) per occurrence for violations of this provision. For the purpose of this provision, each occurrence is a separate offense and subject to the mandatory fine. These fines are in addition to any criminal charges that may be filed. These fines are also in addition to specific replacement costs and damages which will be added for repair charges to any portion of the Town’s water system, including meters, meter pits, meter stops, boxes and lines, and the labor and equipment charges for such repairs.
   (B)   For the purpose of this provision, meter tampering consists of turning a water meter on or off, cutting any lock, or otherwise adjusting or interfering with, or attempting to bypass the normal operation of any water meter attached to the Town’s water system, without the express specific authorization of the Water Utility Superintendent or any one designated by the Superintendent.
