§ 54.04 REFUND OR APPLICATION OF WATER UTILITY DEPOSIT.
   (A)   Any customer of the Town utilities who has paid a utility deposit shall have the deposit returned to them within thirty (30) days after the last water bill has been paid in full, if the customer submits to the Town a written request for return of the deposit. If the balance owed on the last bill is less than the amount of the deposit, upon written request by the customer, the deposit can be applied to the final bill and any remaining balance will then be remitted to the customer. In the event any balance remains unpaid for sixty (60) days from the date of the final bill, the Town utility may apply the deposit to the final bill without any required action of the customer.
   (B)   Any customer of the Town utilities, who has paid a utility deposit on one property, may request that the deposit be transferred or credited to another property when the final bill for the first property has been paid in full.
   (C)   Any customer may, by written request, allow the subsequent owner/occupant of a property to have a deposit retained by the Town for the credit of the subsequent utility customer. The final utility bill must be paid in full, and all other utility transfer information established before this deposit may be credited to the subsequent utility customer.
   (D)   Pursuant to Indiana statute, any unclaimed utility deposits shall be transferred to the water operating fund after the period of two (2) years from the date of final billing for service.
