(A) Fees. There are established fees which may be collected by the Fire Department. Fees shall be established in accordance with the State Fire Marshal, pursuant to 650 I.A.C. 15-1-1 (as on file in the Clerk-Treasurer's office) and shall be computed as follows:
(1) For initial response with fire engine, trucks, or fire apparatus, two-hundred fifty dollars ($250).
(2) For each hour or fraction thereof of on-the-scene assistance, one-hundred fifty dollars ($150).
(3) For expendable materials such as absorption materials or other agents used in cleanup operations, the actual replacement cost of those materials.
(4) For collecting of debris, chemicals, fuel, or contaminated materials resulting from a spill, the actual cost of removal and disposal at an authorized location.

(B) Collection. Fees shall be collected pursuant to I.C. 36-8-12-13. Fees collected pursuant to this section shall be deposited in a separate account to be known as the Fire Department Service Charge Account, and shall thereafter be expended, without appropriation, at the discretion of the Fire Chief, or his designee, pursuant to I.C. 36-8-12-13, for firefighting equipment or supplies.
