§ 31.16 FIRE CHIEF; DUTIES.
   (A)   Fire Chief position created. It is necessary and advisable to provide for the position of full-time Fire Chief for the Brownsburg Fire Territory, and that position is created.

   (B)   Direction. The Chief of the Territory Fire Department shall be subordinate to and obey the orders and directions of the Territory members as directed through the Board of Fire Commissioners.

   (C)   Hours on duty of Fire Chief. The Chief of the Fire Department shale be on duty from 8:00 a.m. to 4:00 p.m. on Monday through Friday, and shall be on call at all times except when he is on authorized vacation, sick leave, or taking compensatory time off.

   (D)   Compensation. The Chief of the Brownsburg Fire Territory shall be paid an annual salary which shall be set by the annual salary ordinance, and in addition thereto, shall be provided with all insurance benefits commensurate with those benefits provided all Fire Territory employees. The Fire Territory reserves the right to review and adjust the annual salary of the Fire Chief with recommendations from the Fire Commission as conditions merit.

   (E)   Retirement benefits of Fire Chief. Retirement benefits shall be limited to participation in the Indiana Public Employee Retirement Fund or the 1977 Police Officers' and Firefighters' Pension and Disability Fund. There shall be no other pension or retirement benefits provided to the Chief of the Fire Department.

   (F)   Automobile of Fire Chief. The Fire Territory shall provide to the Chief of the Fire Department an automobile for his official use. The use of the vehicle shall be determined by written policies set forth by the Board of Fire Commissioners.

   (G)   Duties. The Fire Chief maintains final decision making responsibilities for the overall administration and management of the Fire Department. The Chief shall coordinate and oversee the operations of the command staff personnel. The Chief shall prepare a department budget under the direction of the Board of Fire Commissioners, shall oversee department expenditures, and shall be responsible for the fiscal management of the Fire Department. The Chief shall coordinate activities of the department with other governmental agencies and maintain liaisons with federal, state and local agencies. The Chief shall oversee the selection, training, and appointment of all new firefighters, and is likewise responsible for seeing that all members of the Fire Department are properly trained and certified. He shall be responsible for supervision the maintenance and readiness of the Town's firefighting equipment, buildings, and supplies of the Fire Territory in a proper manner. The Chief shall issue any permits and licenses that the Fire Territory directs and he shall be responsible for any and all duties that are prescribed by state law.

   (H)   Relationship with Fire Department. It is intended that the Chief of the Fire Department shall act in cooperation with the Volunteer Fire Department personnel on behalf of the Fire Territory, and shall be the chief liaison between the Fire Commission and the Volunteer Fire Department personnel.

   (I)   Hiring and discharge of the Fire Chief.  
      (1)   The Chief of the Fire Department shall serve at the pleasure of the members of the Fire Territory (Town of Brownsburg, Brown and Lincoln Townships) who shall have control of the hiring and discharging of the Fire Chief. The Board of Fire Commissioners may make recommendations to the Fire Territory members regarding the hiring or discharging of the Fire Chief.
      (2)   A member who is removed from an upper level policy-making position (i.e., Fire Chief) shall be reassigned a position within the department as per I.C. 36-8-3.5-11(d).
