(a) Responsibilities of Planning Commission.
(1) Recommend the proposed Zoning Ordinance, including text and Official Zoning District Map to the Municipal Council for formal adoption.
(2) Initiate advisable Official Zoning District Map changes, or changes in the text of the Zoning Ordinance where same will promote the best interest of the public in general through recommendation to the Municipal Council.
(3) Review all proposed amendments to this Ordinance (text and/or map) and make recommendations to the Municipal Council, as specified in Charter Section 4.11.
(4) Review all planned unit development and make recommendations to the Municipal Council as provided in Chapter 1151.
(5) Review all special uses as identified in the respective zoning districts according to provisions and criteria stated in Chapter 1163.
(6) The Municipal Planning Commission and pertinent Municipal staff shall carry on a continuous review of the effectiveness and appropriateness of the Zoning Ordinance and recommend such changes or amendments as it feels would be appropriate to update this Ordinance.
(b) Proceedings of Planning Commission. The Commission shall adopt rules necessary to the conduct of its affairs in keeping with provisions of this Ordinance. Meetings shall be held at the call of the chairman and at such other times as the Commission may determine. All meetings shall be open to the public. The Commission shall keep minutes of its proceedings showing the vote of each member upon each questions, or if absent or failing to vote, indicating that fact, and shall keep records of its examinations and other official actions all of which shall be a public record and be immediately filed in the office of the Commission.
(c) Modification of Frontage, Setback and Building Size Requirements. With respect to frontage and setback requirements and building size requirements as well as area requirements for any applicable zone, the Planning Commission is hereby authorized to waive or modify certain requirements as necessary to achieve compatible development with adjacent land areas as well as in the interest of the community in general. In doing so, the Planning Commission shall examine the adjacent land areas before making their decision and shall take into consideration the Master Plan adopted by Council. The Planning Commission may also impose those additional conditions, guarantees, and safeguards as it deems necessary for the general welfare of the community, and for the protection of the individual property rights as well as for insuring that the objectives of the Master Plan and the Zoning Ordinances as well as this Ordinance are observed.
