331.39 PATH AND BIKEWAY USE; SIGN POSTED.
   (a)   No person shall operate a motor vehicle, snowmobile, all purpose vehicle or horse upon any path or bikeway set aside for the exclusive use of bicycles and pedestrian traffic, when an appropriate sign giving notice of such use is posted on the path or bikeway.
   (b)   This section shall not prohibit public service vehicles, including but not limited to, service and maintenance vehicles and equipment, police, fire and emergency vehicles, from operating on said paths or bikeways in performance of official duties.

   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
