155.01 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   (a)   "Labor organization” means an organization of any kind or any agency or employee representation committee or plan in which public employees participate and which exists, in whole or in part, to deal with public employers concerning grievances, labor disputes, and terms and conditions of employment.
   (b)   "Municipal employee” means any person holding a position by appointment or employment in the service of the Municipality, except:
      (1)    Persons holding elective office;
      (2)    Persons appointed to an office or position by the Municipal Manager or Council, except such persons who are not the head of a division in a department or higher;
      (3)    The head of any department vested with control over the department and with power to appoint and remove officers and employees in such department or to effectively recommend appointment or removal;
      (4)    Supervisors.
   (c)   "Strike" means any stoppage of work, refusal to work, or slowdown in work by an employee or employees acting in concert.
   (d)   "Supervisor" means a person with authority, on behalf of the Municipality, to hire, transfer, suspend, layoff, recall, promote, discharge, assign, reward, or discipline other public employees, or responsibly to direct them, or to adjust their grievances, or effectively to recommend any such action. A supervisor is a person whose duties require the exercise of independent judgment and whose duties are not of a clerical or routine nature. (Ord. 1980-8. Passed 7-15-80.)
