Sec. 10.02 Referendum.
   (A)    Any ordinance or resolution passed by the Council, except for ordinances and resolutions that take effect under the provisions of division (A) of Section 4.07 of this Charter, shall be subject to referendum under this section if, within 30 days after its passage, a petition signed by electors equal in number to ten percent of the number of votes cast at the last preceding regular municipal election is filed with the Clerk of Council requesting that such ordinance or resolution, or any specified part thereof, be submitted to a vote of the electors. Such ordinance or resolution, or such specified part thereof, shall not become effective, and it shall be submitted to a vote of the electors of the Municipality at the next regular primary or general election conducted in the Municipality, provided that such election day shall occur at least 45 days after receipt of the certificate by the Clerk of Council that the referendum petitions filed have been found to be sufficient; however, the Council may provide for referring such ordinance or resolution, or specified part thereof, to the electors at a special election on a date fixed by the Council upon a two-thirds vote of the members of the Council.
   (B)    Referendum petitions shall be prepared and filed in the manner and form prescribed, and may be amended as provided in the foregoing sections of this Charter for an initiative petition for an ordinance or resolution; however, such petitions may be amended once only. If the Clerk of Council finds that the amended petitions are insufficient, Or in the event he finds the original petitions are insufficient and amended petitions are not filed within the time allowed, the Clerk shall certify a finding of insufficiency to the petitioner's committee, and further referendum petitions may not be filed on such ordinance or resolution, or part thereof. If the original or amended petitions are found to be sufficient, the Clerk of Council shall certify such finding to the Council, and the Council shall refer such ordinance or resolution, or part thereof, to the electors as provided in division (A) of this section.
