(A)
The rates for the several classes of users of, or property to be served by, the Brookston Municipal Sewage Utility shall be as follows.

(B) (1) Tap fees. Each user shall pay $50 at the time of connection with the wastewater utility.
(2) Collection of deferred payment charge. All bills shall be due and payable on the first day of the month following the date of billing. Bills remaining unpaid 17 days of billings shall include a collection charge of 10% on the balance of the unpaid billing.
(3) This division (B) shall be in full force and effect from and after its passage and signing by the President of the Town Council.
(C) Storm water user fee. There is hereby established a monthly storm water user fee for the use of the storm water management services provided by the town, as follows.
(1) The Town Council is authorized and directed to assess each parcel served by the system a monthly storm water user fee.
(2) A monthly storm water user fee shall be uniform for all properties, which shall be assigned one Equivalent Residential Unit (ERU), without regard to the area of the parcel.
(3) The storm water user fee for one ERU is hereby established for each parcel at the rate of $2.20 per month.
(4) The storm water user fees established under this section are authorized under the provisions of I.C. 36-9-23 and such fees shall be in all respects revenues of the town’s sewage utility.
(5) The storm water user fees levied pursuant to this section shall be in effect from the first billing date in November 2016, and shall be shown on the sewage utility billing statement due and payable on or before the due date thereon. Any storm water user fee not paid by the due date shall be considered delinquent and a delinquent charge of 10% of the applicable monthly rate billed shall be assessed and added to the next utility bill.
(6) Delinquent storm water user fees constitute a lien against the property assessed and may be collected along with applied penalties, recording fees and service charges in accordance with I.C. 36-9-23-32 and I.C. 36-9-23-33, and such delinquent fees together with penalties, costs of collection, legal fees and court costs may be collected by all other available remedies at law.
(7) The storm water user fees established under this section shall be in all respects revenues of the town's sewage utility, to be used to defray the costs for either Brookston Storm Water or Sewage Utility improvement projects.
