§ 122.12 EXCEPTIONS AND DEFENSES.
   Nothing in this chapter prohibits a native Indian from furnishing tobacco, tobacco products or tobacco related devices to an Indian under the age of 21 years if the tobacco is furnished as a part of a traditional Indian spiritual or cultural ceremony. It is an affirmative defense to the violation of this chapter for a person to have reasonably relied on proof of age as described by state law.
