(a) No person shall drive or operate a motor vehicle which is equipped with special engine brakes or “Jake brakes” in such a manner that the use of said brakes is likely to cause inconvenience or annoyance to persons of ordinary sensibilities.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree for a first offense. For a subsequent offense, the person is guilty of a misdemeanor of the third degree. The penalty shall be as provided in Section 408.01.
