1268.031   PROHIBITED USES.
   (a)   In a Residential District, the following uses are prohibited:
      (1)   Landfills or transfer stations;
      (2)   Construction and demolition debris facilities as defined in Ohio R.C. Chapter 3714;
      (3)   Solid waste facilities as defined in Ohio R.C. Chapter 3734;
      (4)   Recycling facilities;
      (5)   Facilities for the commercial composting of materials including, but not limited to, garbage, offal, dead animals, animal waste, yard products or refuse;
      (6)   Facilities for the storage of garbage, offal, dead animals or refuse, including refuse reduction;
      (7)   Facilities for storage, sorting or baling of junk, scrap metal, paper or rags; and
      (8)   Uses which may be noxious or offensive or threaten the health and safety of the public by reason of the emission of odor, dust, smoke, vibration or noise.
   (b)   Any such uses existing and lawful at the time of the enactment of this Zoning Code, including such uses as are permitted by license of the Cuyahoga County Board of Health or the Ohio Environmental Protection Agency, are subject to regulation under Section 1286.02 and to such conditions and safeguards as the Council may determine are necessary for the protection of the public health, safety and morals of the Village.
   (c)   As used in this section, the term “commercial composting” shall mean receipt of materials produced by others, including, but not limited to, garbage, offal, dead animals, animal waste, yard products or refuse in exchange for a fee or otherwise for profit. It does not include composting of materials actually produced by the landowner for private use. Composting that results in objectionable odors and/or includes prohibited material is considered to be a public nuisance.
