All permanent, outdoor pools shall be set away from the property lines and completely enclosed by a fence. The fee for such permit shall be as set forth in Section 1444.14(p).
(a) All pools shall be set away from the lines specified below:
(1) On lots with 40-foot zoned frontage, no less than 5 feet.
(2) On lots with 41 to 60-foot zoned frontage, no less than 10 feet;
(3) On lots with 61-foot zoned frontage or greater, no less than 15 feet.
(b) All fences installed immediately around the pool or the entire yard, whether new or existing, shall be 4 feet high, and all fences shall have an effective means of denying access to the area, such as a locked gate.
(c) In the case of an in-ground pool, the fence must be located at least 5 feet from the pool.
(d) In the case of an above-the-ground pool, the walls of the pool above the ground may be used as the lower portion of the 4-foot high fence requirement. The added portion must be of sturdy construction. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches measured on the side of the barrier which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an aboveground pool, the barrier may be at ground level, such as the pool structure, or mounted on the top of the pool structure. Where the barrier is mounted on the top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches. Such pools shall have a removable folding ladder and locking ladder. All portable pools with decks must have a gate which permits locking.
(e) The width or length of any open spaces within the fence or gate shall not exceed 4 inches.
