1224.01   PLAN REQUIRED FOR DEVELOPMENT OF VACANT LAND; APPROVAL BY COUNCIL.
   (a)   In the event that any developer intends to make changes in the contour of any land proposed to be subdivided, developed or changed in use by grading, excavating or the removal or destruction of the natural topsoil, trees or other vegetative covering thereon, the same shall only be accomplished after the owner of said land, or his or her agent, has submitted to Council, or its duly authorized representative, for approval, a plan for erosion and sedimentation control, unless there has been a prior determination by Council, or its duly authorized representative, that such plan is not necessary.
   (b)   Such plan shall contain adequate measures for control of erosion and siltation where necessary, using the guidelines and policies contained herein.
   (c)   Council, or its duly authorized representative, shall review the plan as submitted, and shall take necessary steps to insure compliance by the developer with the plan as finally approved.
      (1)   Council, in its consideration of each preliminary plan or extension of a previously approved plan, shall condition its approval upon the execution by the developer of erosion and sedimentation control measures, to be specified by Council after receiving recommendations from the Cuyahoga Soil and Water Conservation District.
      (2)   One copy of each approved preliminary plan or extension of a previously approved plan requiring erosion and sedimentation control measures shall be referred to the Cuyahoga Soil and Water Conservation District for review and recommendation as to adequate erosion and sedimentation control measures to prevent damage to other properties.
      (3)   The installation and maintenance of the specified erosion and sedimentation control measures shall be accomplished in accordance with the procedures, standards and specifications on file with the Cuyahoga Soil and Water Conservation District.
