1068.16   PERSONS ENTITLED TO USE PARKS; GROUP USAGE.
   (a)   The Village parks are constructed and maintained for the use of the public at large and shall be open daily to all residents. No person shall be given special privileges therein nor be permitted to make use of any park for any purpose not consistent with the proper use thereof.
   (b)   When any individual inhabitant of the Village is a member of a group, club, union, lodge, family reunion or association, hereinafter referred to as a “group,” and desires to use the recreational facilities for a group of fifteen to twenty-five persons, a permit must be obtained, but no deposit will be paid. For a group exceeding twenty-five persons, a permit must be obtained and a deposit of seventy-five dollars ($75.00) shall be made. Such deposit shall be used for clean-up of the reserved facilities or restitution for any damage occasioned by the use thereof. The deposit or any remaining balance thereof shall be refunded to the permit applicant, except that applications for refund shall not be presented earlier than three days following the event.

   (c)   In addition to the above fees, an extra charge of one hundred dollars ($100.00) shall be made for clambakes.

   (d)   Application for a permit must be made in writing to and upon application forms furnished by the Village. Such an application shall state the name and address of the applicant and of the group for which he or she is applying and the time or period for which the facilities are to be used. On being satisfied that such applicant is an inhabitant of the Village, that no other permit for the same person or group has been granted for the same date and that no other permit for the same person or group is outstanding or pending at the time desired for the date being applied for, a permit shall be issued by the Clerk/Treasurer to and in the name of the applicant, which shall contain the essential information set forth in the application. Whenever such application is for a group in excess of 150 persons, or if for a lesser number, but such application, if granted, together with other permits already granted, or all the applications taken together, would exceed 150 persons in the park at any given time, such permit shall not be issued until the Park and Playground/Human Services Committee of Council shall approve the same in writing. A permit shall not be issued for more than one day unless the Council Committee shall approve the same in writing. Whenever, by virtue of permits issued by the Clerk/Treasurer, and by virtue of applications approved by the Council Committee, the number of persons permitted to use such recreational facilities at any given period equals 225 persons, no further permits shall be issued and the Council Committee shall notify the Clerk/Treasurer that the quota of the park is filled and he or she shall receive no applications for said period. The Clerk/Treasurer shall not be required to receive any applications until May 1 of each year for that calendar year. Applications received on said date and those received thereafter shall be processed by the Clerk/Treasurer in the order of their receipt. If an application is received for a period for which the quota of the park has been reached and a different period then and there cannot be substituted, then such application shall be deemed withdrawn so that other applications can be processed. The members of such a group under such a permit shall be entitled to use such recreational facilities only so long as the permittee remains with such group in the park, and such permittee shall be responsible at all times for the conduct of the group and for any damage done to any of the recreational facilities through misuse.
