§ 94.38  NOTICE TO OWNER.
   (A)   Within five days after the passing of the resolution the City Manager shall prepare a written notice signed by him or her and addressed to the owner of any lot or premises in front of or adjacent to which sidewalk is to be constructed or rebuilt, requiring the person or persons to construct or rebuild the sidewalks or portion thereof as may be ordered in front of or adjacent to the several parcels of land so owned by him or her within 30 days from the date of the notice; which notice shall be served by the Chief of Police by delivering the same to the person or persons personally, if found within the city, within five days from the date thereof; but if not so found within five days then the notice shall be published at least once during the week next thereafter in one or more newspapers published and circulating in the city.
   (B)   In case the owner of the lot or premises is unknown the notice shall be published at least once each week for two weeks in succession in a newspaper published and circulating in the city commencing with the first issue of the newspaper next after the date of the notice. A copy of every notice served by the Chief of Police shall be preserved, and he or she shall certify thereon the time and manner of the service, and return the same to the Clerk/Treasurer to be by him or her filed and preserved.
