§ 52.28  SIGNATORY REQUIREMENTS FOR INDUSTRIAL USER REPORTS.
   (A)   The industrial user shall provide the statement contained in this § 52.36(B)(2), certifying that all pretreatment standards are being met on a consistent basis, and if not, whether additional operation and maintenance measures or additional pretreatment is required for the industrial user to meet the pretreatment standards.
   (B)   The certification statement shall be signed as follows:
      (1)   By a responsible corporate officer. A responsible corporate officer means a president, secretary, treasurer or vice president of the corporation in charge of principal business function, or any other person who performs similar policy or decision-making functions for the corporation. A responsible corporate officer or operation facilities employing more than 250 persons or having gross annual sales or expenditures of more than $250,000 in second quarter 1980 dollars, if authority to sign the documents has been assigned or delegated to the manager in accordance with corporate procedures;
      (2)   By a general partner or proprietor, if the industrial user submitting the reports is a partnership or sole proprietorship respectively; and
      (3)   By a duly authorized representative of the individual described in divisions (B)(1) or (2) above if:
         (a)   The authorization is made in writing by the individual described in divisions (B)(1) and (2) above;
         (b)   The authorization specifies either an individual or a position having responsibility for the overall operation of the facility from which the industrial discharge originates or that has overall responsibility for environmental matters for the company; and
         (c)   The written authorization is submitted to the city. If an authorization is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for environmental matters for the company, a new authorization must be submitted to the city prior to or together with any reports to be signed by an authorized representative.
