When the City Fire Department responds to a call for assistance in connection with an actual or threatened hazardous materials release, actual cost incurred by the Fire Department and city may, at the city’s sole discretion, be imposed upon the responsible parties, including, but not limited to:
(A) Expenses incurred by the city in responding to the hazardous materials incident, including, but not limited to, rental or purchase of machinery, equipment, labor, consultants, legal and engineering fees, medical and hospitalization costs, ambulance stand-by and transport costs, replacement costs related to disposable and non-disposable items and equipment such as, but not limited to, personal protective equipment, extinguishing agents, supplies, hoses, nozzles, fire trucks, and related equipment, decontamination of equipment, meals and refreshments for personnel while responding to the hazardous material incident. Expenses will also include, but are not limited to, the above expenses for any mutual-aid fire department, as well as costs incurred in contracting with outside agencies for work related to the hazardous material incident;
(B) Charges to the city imposed by any local, state or federal government entities related to the hazardous material incident;
(C) Costs incurred in accounting for all hazardous material incident related expenditures, including billing and collection;
(D) Reimbursement of $15 per hour, or a fraction thereof, for each paid on-call, part-time and full-time fire personnel needed, in the opinion of the officer in command, to stand-by at the hazardous material incident scene, at the fire station or any other designated location; and
(E) A fee of $150 per hour, or a fraction thereof, for each search engine, aerial, tanker or rescue apparatus required in the opinion of the officer in command, to stand-by at the hazardous material incident scene or any other designated area. For each hour that the pumps are activated, an additional sum of $50 per hour shall be charged for each pump operating.
