(A) In order to protect the city from incurring extraordinary expenses resulting from the utilization of city resources to respond to an incident involving hazardous materials, the City Council authorized the imposition of charges to recover reasonable and actual costs incurred by the city in responding to calls for assistance in connection with a hazardous materials release.
(B) Action to impose and or collect these fees shall be at the option of the City Council. This subchapter recognizes that the city is a part of the City Rural Fire Association, and the City Fire Department is the response agency for the city. Further, for the purpose of this subchapter, that expenses incurred by the City Rural Fire Association, the City Fire Department and the city as a result of a hazardous material incident within this city shall be considered as the chargeable expense of the city as it directly relates to cost recovery by this subchapter.
