CHAPTER VI
CITY ADMINISTRATION
ADMINISTRATIVE OFFICERS:
Section 6.1 (a) The administrative officers of the city shall be the city manager, city clerk, city treasurer, and such additional administrative officers as may be created by ordinance. The duties of one or more of the administrative officers of the city may be performed by one person when determined by the council for an indefinite period, shall be responsible to and serve at the pleasure of the council, and shall have compensation fixed by the council.
(b) All administrative employees of the city, except the city manager, city clerk, and city treasurer, shall be appointed by the city manager for indefinite term of office, subject to the confirmation of the council. Such employees compensation shall be fixed by the city manager in accordance with budget appropriations and subject to approval by the council.
(c) All personnel employed by the city who are not elected officers of the city, or declared to be administrative officers, or under the authority of this charter, shall be deemed to be employees of the city. The head of each department shall have the authority to hire and discharge the employees of that department upon the advice and consent of the city manager, subject to the provisions of any merit or civil service system.
CITY MANAGER:
Section 6.2 (a) The city manager shall be the chief administrative officer of the city government. He or she shall be selected by the council on the basis of training and ability. The city manager shall serve for an indefinite period and at the pleasure of and be subject to removal by the council, pursuant to section 4.16 of this charter. Compensation shall be fixed by the council.
(b) The council shall appoint the city manager within ninety (90) days after any vacancy exists in such position and they may appoint an acting manager during the period of vacancy in the office. The city manager, with the consent and approval of the council, may designate an administrative officer or employee of the city to act as city manager if he or she is temporarily absent from the city or unable to perform the duties of the office. No person who holds or has held elective office in the city of Bronson shall be eligible for appointment as city manager or acting city, manager during a vacancy in that office until two (2) years have elapsed following the expiration of the term for which this person was elected.
CITY MANAGER -- FUNCTIONS AND DUTIES:
Section 6.3 (a) The city manager shall be responsible to the council for the proper administration of the affairs of the city. It shall be the manager’s responsibility to recommend appointments and removals of administrative personnel, subject to the confirmation of the council. The manager shall establish administrative personnel and employees’ compensation in accordance with budget appropriations. He or she shall supervise and coordinate the work of the administrative employees and departments of the city, except the work of the city clerk in keeping the council records and as clerical official of the council. The city manager shall have council approval before retaining for compensation any firm or individual(s).
(b) The city manager shall see that all laws and ordinances are enforced. The manager shall prepare and administer the annual budget under the policies formulated by the council and shall keep the council advised as to the financial condition and the needs of the city. The manager shall furnish the council with information concerning city affairs and prepare such reports as may be required, or which the council may request, including an annual report encompassing the activities of the several departments. The city manager shall be responsible for the supervision and coordination of personnel policies and practices of the city. The city manager shall be responsible, subject to council approval, for the creation and maintenance of an employee manual, He or she shall establish and maintain a central purchasing service for the city, and he or she or an authorized reresentative shall be the purchasing agent for the city.
(c) The city manager shall attend all meetings of the council, with the right to be heard in all council proceedings but without the right to vote. He or she shall possess such other responsibilities and perform such additional duties as may be granted to or be required by the council, so far as may be consistent with the provision of law. He or she shall establish any rules necessary to carry out any or the foregoing duties.
CITY CLERK:
Section 6.4 (a) The City Clerk shall serve at the pleasure of the Council.
(b) The clerk shall be the clerical officer of the council and shall keep its journal. The clerk shall keep a record of all action of the council at its regular and special meetings. The clerk shall certify all ordinances and resolutions adopted by the council;
(c) have power to administer all oaths required by law, this charter or the ordinances of the city;
(d) be custodian of the city seal, and shall affix it to all documents and instruments requiring the seal, attest the same, and shall also be custodian of all papers, documents, and records pertaining to the City of Bronson, the custody of which is not otherwise provided for by this charter and shall attest the same whenever required to do so;
(e) give the proper officials of the city ample notice of the expiration or termination of any official bonds, franchises, contracts or agreements;
(f) perform such other duties as may be prescribed in the capacity of clerk of the city, by law or this charter.
(g) the council shall appoint a city clerk within forty-five (45) days after any vacancy exists in such position and they, may appoint an acting city clerk during the period of vacancy in the office.
DEPUTY - CLERK:
Section 6.5 The clerk may appoint a deputy subject to the written confirmation by the city, manager. The clerk may terminate the status of the deputy upon written notice to the city manager. The deputy clerk shall have the authority to assume the duties of the clerk in the clerk’s absence.
CITY TREASURER:
Section 6.6 (a) The city treasurer shall serve at the pleasure of the Council.
(b) The city treasurer shall be the general accountant of the city and shall keep the books of account of the assets, receipts and expenditures of the city except as otherwise provided by state law or by this charter; the system of accounts of the city shall conform to such uniform system as may be required by law;
(c) examine and audit all accounts and claims against the city;
(d) have the custody of all moneys of the city, and all evidences of value belonging to the city, or held in trust by the city;
(e) receive all moneys belonging to and receivable by the city;
(f) keep and deposit all moneys or funds in such manner and only in such places as the council may determine and report the same to the city manager, and to the council;
(g) have such powers, duties and prerogatives in regard to the collection and custody of State, County, School District and City taxes upon real and personal property;
(h) perform such other duties as may be prescribed in the capacity of treasurer of the city, by law or this charter.
(i) the council shall appoint the city treasurer within forty-five (45) days after any vacancy exists in such position and they may appoint an acting city treasurer during the period of vacancy in the office.
ADDITIONAL ADMINISTRATIVE POWERS, DUTIES, AND RESTRICTIONS:
Section 6.7 (a) The council shall by ordinance establish departments of city government and determine and prescribe the functions and duties of each department. The council may by ordinance prescribe additional powers and duties and diminish any powers and duties in a manner not inconsistent with the charter, to be exercised and administered by appropriate officials in departments of the city.
(b) Anti-nepotism. Unless the council shall determine by unanimous vote, which vote shall be recorded as part of its official proceedings, that the best interests of the city shall be served, the following relatives of any elected or appointed officer are disqualified from holding any appointive office or employment during the term for which said elective or appointive officer is elected or appointed: spouse, child, parents, grandchild, grandparents, brother, sister, half-sister, half-brother, or the spouses of any of them. All relationships shall include those arising from adoption. This section shall in no way disqualify such relatives or their spouses who are bonafied appointive officers or employees of the city at the time of the election or appointment of said official.
CITY PLANNING:
Section 6.8 The council shall provide for and maintain a city planning commission, which shall possess all powers and perform the functions of planning commissions as set forth by statute. The members of the planning commission shall be appointed by the mayor subject to the confirmation of the council. The members of the commission shall serve without compensation, except for necessary expenses in connection with their work.
ZONING BOARD OF APPEALS:
Section 6.9 The council shall serve as the Zoning Board of Appeals, and shall possess all powers and perform all functions as set forth by statute. Council members shall receive no additional compensation for their work as the Zoning Board of Appeals, except for necessary expenses in connection with their work.
PERSONNEL MANAGEMENT SYSTEM:
Section 6.10 The council shall provide by ordinance a merit system of personnel management for the city, including a position classification and pay plan, which shall be part of the administrative code.
COMPENSATION AND EMPLOYEE BENEFITS:
Section 6.11 The council shall have the power to make available to the administrative officers and employees of the city and its departments, an annually funded pension plan by ordinance, and any recognized group plan of life, hospital, health, or accident and income protection service, or any one or more thereof.
