(A) No person shall possess or use alcoholic beverages on any property owned by the city.
(B) Notwithstanding the provisions of division (A) of this section, the possession or use of beer may be permitted on city property by the Mayor and a majority of Council upon the filing of an application by any nonprofit organization sponsoring a city activity open to all the residents of the city.
(1) Said application shall identify the sponsoring entity, identify an individual natural person responsible for receiving all communications from the city, specify the date or dates of the proposed event, agree to be responsible for the cost of any police protection necessary (unless waived by the city) and agree to indemnify and save the city harmless from any and all liability in connection with the serving and the use of beer on the property during said event.
(2) The Mayor may cause the Police Department to investigate the applicant to determine whether there is any history of past criminal violations.
(3) Upon receipt of said application and a payment of a filing fee of $25 (which shall be used to process said application), if the Mayor and a majority of Council are satisfied that the organization seeking said permit is a responsible community organization with no history of criminal activity, the Mayor shall issue a permit for possession or use of beer on city property for the duration of said event.
