(A) (1) Except as provided in division (B) of this section, whoever violates any of the weight provisions of § 440.01 shall be fined in accordance with the following schedule.

(2) In addition to the fines herein designated, whoever violates any of the weight provisions of § 440.01 may be imprisoned for not more than six months.
(B) No penalty prescribed in this section shall be imposed on any vehicle combination if:
(1) The overload on any axle does not exceed 1,000 pounds; and
(2) The immediately preceding or following axle, except the front axle of the vehicle combination, is underloaded by the same or a greater amount. For purposes of this division, two axles on one vehicle less than eight feet apart shall be considered as one axle.
(C) Whoever violates or fails to comply with any of the provisions of § 440.01(F) shall be fined not less than $500 nor more than $1,000.
