§ 1320.05 EXEMPTION FROM PERMIT AND BOND REQUIREMENTS; DUTY TO REPLACE TOPSOIL OR LOAM.
   A person excavating or grading land to the grade fixed by the City Engineer for the purpose of constructing thereon any building, structure or other improvement permitted in any present or future use district pursuant to a building permit duly issued by the Building Commissioner, is not required to comply with §§ 1320.01 through 1320.04, but shall, upon completion of such excavation or grading operations, replace the topsoil or loam over the area from which the same was moved (excluding therefrom the area covered by the building, structure or other improvement placed thereon) equal to the depth of such loam or topsoil before the moving or removal thereof, or to a depth of three inches, whichever is less.
