§ 1650.06 OUTDOOR HEATING AND COOKING EQUIPMENT.
   (A)   No person shall install, construct or use, for the purpose for which such is designed, any chiminea, fire basket, patio heater, hibachi, outdoor barbecue grill or other grill, broiler or oven of the domestic variety commonly used for outdoor cooking, or other similar utensil, other than upon the ground floor level of a premises and then only if such utensil is located 15 feet or more from any dwelling, garage or other structure or part thereof.
   (B)   No person shall fail to extinguish any fire or burning embers, with water or other suitable means, in any hibachi, outdoor barbecue grill or other grill, broiler or oven of the domestic variety commonly used for outdoor cooking, or other similar utensil, after the use of such utensil for cooking has terminated.
   (C)   No person shall fail to take whatever measures are necessary to prevent the spread to the surrounding area of hot sparks or burning embers or coals from the pit of any chiminea, fire basket, patio heater, hibachi, outdoor barbecue grill or other grill, broiler or oven of the domestic variety commonly used for outdoor cooking, or other similar utensil. Any fire or other damage or injury which, in the judgment of the Fire Chief, is occasioned by the spread of hot sparks or burning embers or coals, shall constitute prima facie evidence of intent, on the part of the owner of the premises upon which the utensil is located, to violate this division.
   (D)   No person shall place or store any chiminea, fire basket, patio heater, hibachi, outdoor barbecue grill or other grill, broiler or oven of the domestic or commercial variety commonly used for outdoor cooking, or other similar utensil, on any porch, balcony, mezzanine or other similar type area that is not itself on the ground floor.
