§ 1650.01 SMOKING PROHIBITED IN CERTAIN AREAS.
   (A)   Where Flammable Finishes are Applied. Smoking is hereby prohibited in any spray finishing or coating areas and in the vicinity of dip tanks. “No Smoking” signs with lettering of an approved size shall be conspicuously posted in such areas and shall read “No Smoking - Broadview Heights Fire Prevention Bureau.”
   (B)   Other Areas.
      (1)   Where conditions are such as to make smoking a hazard in any areas of piers, wharves, warehouses, stores, industrial plants, institutions, places of assembly, and in open spaces where combustible materials are stored or handled, the Chief of the Bureau of Fire Prevention is authorized to order the owner or occupant in writing to post “No Smoking” signs in each building, structure, room or place in which smoking shall be prohibited. The Chief of the Bureau of Fire Prevention shall designate specific safe locations, if necessary, in any building, structure or place in which smoking may be permitted.
      (2)   “No Smoking” signs of approved sized lettering and location required in accordance with division (B)(1) hereof shall read “No Smoking - Broadview Heights Fire Prevention Bureau.”
      (3)   No person shall remove any legally required “No Smoking” sign or smoke in any place where such signs are posted.
   (C)   Smoking Defined. As used in this section “smoking” means and includes the carrying of a lighted pipe, cigar, cigarette or tobacco in any form.
