(A) The builder or permit holder shall not assign or transfer his or her obligations relative to final inspection without the express written consent of the parties involved and approval by the Building Commissioner and City Engineer.
(B) No builder or permit holder shall transfer property to a homeowner prior to the issuance of a certificate of occupancy by the Building Commissioner and no person shall occupy a new or remodeled structure until the same has been issued a certificate of occupancy by the Building Commissioner.
(C) No person shall use or occupy any nonresidential structure until the same has been inspected and until the same has been issued a certificate of occupancy by the Building Commissioner. This section shall apply to all changes in ownership, tenancy and/or occupancy in all nonresidential buildings, suites or units or portions thereof.
(D) A fee as established in Chapter 1449, Fee Schedule, shall be paid for the inspection and certificate of occupancy, when applicable.
(E) No building permit shall be issued for any residential or nonresidential structure for which a landscaping plan or lawn installation, grading and paving is otherwise required by this Code of Ordinances unless and until such plan has been approved by the city and unless and until the builder or developer has deposited a cash bond or secured a performance bond in the amount calculated by the City Engineer applicable to the development or building to secure the proper installation of the site grading, landscaping, lawn and paving.
(F) (1) No occupancy permit shall be issued for any new building, renovation, alteration and addition of residential or nonresidential structure pursuant to the ordinances of the city unless and until a site plan delineating the final topography of the site has been submitted by the builder to the city and until the City Engineer has certified that the finished grade conforms to and complies with the topographical site plans submitted. The applicant shall allow at least five days for the final grade inspection and certification. Once final grade has been approved by the City Engineer, the final grade bond and concrete bond will be refunded to the applicant. The city will retain the lawn bond or performance bond until the site has achieved 70% vegetation as determined by the City Engineer. If the work is not completed within one year, the applicant may, in writing, explain the reasoning to the Building Commissioner. The Building Commissioner may extend the bond period until construction is complete or the bond amount shall be forfeited to the city and the funds used to complete the work. In the event that the cost to complete the work exceeds the amount of the cash bond or performance bond , the builder will be billed for the difference and will be required to pay the entire amount within 30 days.
(2) All survey pins set or found, as noted on the approved topographical site plan submitted, shall be in place, exposed and clearly marked at the time of the finished grade inspection required herein.
