§ 264.17 DISABILITY LEAVE.
   (A)   An employee, covered by this chapter, who is disabled as a result of the performance of duties within the scope of his employment, shall be paid, if such disability prevents him from performing his duties, regular compensation during the continuance of such service-related disability, but for a period not to exceed 180 work days from the date that such service-related disability occurred. During such disability leave, compensation shall be paid in accordance with this section, whether or not the employee has accumulated sick leave. In the event accumulated sick leave is available, and a service related disability occurs, the first ten days of said service-related disability shall be charged to said employee's accumulated sick leave, or if less than ten days accumulated sick leave is available, the existing sick leave available shall be charged to disability leave. In no event will an employee receive more than his regular compensation while on disability leave.
   (B)   An employee who obtains a paid leave under this section shall file for Workers' Compensation and sign a waiver assigning to the employer those sums of money (temporary total disability) he would ordinarily receive as his weekly compensation as determined by law for those number of weeks he receives benefits under this section.
