For the purposes of this chapter, a private pool is one constructed or located upon premises and used only by the owner thereof, his or her family, neighbors and guests and for which no fee or remuneration is charged for the use thereof. A public pool is one used by persons other than the owner thereof and for which a fee or remuneration is charged by the owner for the use thereof or which is used by members of a club or association.
