§ 1064.01 FALSE ALARM DEFINED.
   “Fire alarm,” as used in this chapter, includes any alarm or report of an alarm received by the Police or Fire Department of the city that has resulted from either the mechanical malfunction of an alarm system located within the municipality and/or the negligence of the owner of property within the municipality and/or his or her agents and/or employees in the setting of the alarm system, including, but not limited to, those which proximately cause the alarm to register and be received by the Police or Fire Department. Whether or not an alarm or a report of an alarm received by the City Police or Fire Department qualifies as a false alarm is a decision to be made by the Chief of Police or Fire Chief of the city, after proper investigation of the circumstances surrounding said alarm receipt has been completed by said municipal officer.
