§ 1044.03 CONNECTION PERMIT REQUIRED; CHARGES.
   (A)   No person, corporation, public agency, partnership or association shall connect, or cause to be connected, any building or other structure, directly or indirectly, with the EPA-financed system for the purpose of discharging sanitary sewage or industrial waste therefrom without first securing from the Building Commissioner or his or her designated representative a permit for such purpose in a form prescribed by Council. In addition, prior to the issuance of such permit, the applicant therefor shall pay the charge provided for in division (B) hereof and any applicable additional charges determined in accordance with this section.
   (B)   The Building Commissioner shall not issue a permit for the purpose described in division (A) hereof until the applicant has paid a charge of $110, which charge is intended to reimburse the city for the reasonable expenses of inspection and other administrative costs related to the making of connections to the system.
   (C)   Where the connection is made into the system, and the property to be connected has not been assessed for a portion of the cost of constructing the system, the Building Commissioner shall not issue a permit for the purpose described in division (A) hereof until the applicant has paid, in addition to the charge specified in division (B) hereof, a connection charge calculated by determining the number of use benefits in accordance with the schedule set forth in § 1044.02, by multiplying the number of use benefits by the rate established in this division (C) for one unit and by multiplying that product by a fraction, the numerator of which is the construction cost index as published in the Engineering News Record as of the date nearest to the date of the application for the connection permit, and the denominator of which is the construction cost index as of the date nearest to the completion date. The charge for a unit of one is hereby established as $628.54.
   (D)   Where the connection is made directly into a trunk or lateral sewer or into a private sewer which connects directly to a lateral sewer, and the property to be connected has not been assessed for a portion of the cost of constructing the system, the Building Commissioner shall not issue a permit for the purpose described in division (A) hereof until the applicant therefor has paid, in addition to the charges specified in divisions (B) and (C) hereof, a connection charge calculated by determining the number of use benefits in accordance with the schedule set forth in § 1044.02, by multiplying the number of use benefits by the rate established in this division (D) for one unit and by multiplying the product by a fraction, the numerator of which is the construction cost index as published in the Engineering News Record as of the date nearest to the date of the application for the connection permit, and the denominator of which is the construction cost index as of the date nearest to the completion date. The charge for a unit shall be based upon frontage and is hereby established as $24.45 per foot.
   (E)   The permit charges determined under divisions (C) and (D) hereof stall be increased by an amount equal to 5% of the initial charge on July 1, 1988, and on July 1 each year thereafter until July 1, 2007. Such charges as so increased, when added to the charge set forth in division (B) hereof, shall be the total connection permit charge. The incremental charges as set forth in this division (E) are designed to offset the interest costs incurred by the city in constructing the system.
   (F)   In any case where a connection is to be made from any lot or land, or building or other structure thereon, directly into a trunk or lateral sewer or into a private sewer which connects directly to a lateral sewer, and such lot or land has not been assessed for a portion of the cost of constructing the system, the aggregate of the charges provided in divisions (B), (C) and (D) hereof shall be increased by an amount equal to the number of front feet of the lot or land bounding and abutting upon the street or easement in which the sewer to which the connection to be made is located $628.54 per unit; $24.45 per foot of frontage, plus interest at the rate of 5% per year commencing with the completion date of the particular improvement from which the property making the connection will benefit.
