§ 1040.03 EMERGENCIES.
   (A)   Declaration. Whenever the Division of Water of the City of Cleveland issues a directive to the public to conserve water, or at any time that the Director of Public Safety determines that a significant water shortage exists in the City of Broadview Heights, a public water emergency shall be deemed to exist.
   (B)   Notice. Whenever such an emergency exists, the Director of Public Safety shall request the cooperation of the local press and radio and television stations to announce the emergency and the time that emergency use regulations will become effective. Such emergency use regulations shall become effective not sooner than one hour after the first announcement. Such announcement by two local radio stations, or in a daily newspaper of general circulation in the city, shall constitute notice to the general public of the existence of the emergency. The emergency shall continue until an announcement by the Director or the City of Cleveland, Division of Water, that the emergency has ceased to exist. Such announcement shall be made in the same manner as provided in this division (A) for an emergency.
   (C)   Imposition of Regulations. During the period of an emergency, the Director may prohibit the use of any water for the sprinkling or irrigation of lawns and/or gardens, for the washing of motor vehicles and for the filling of swimming pools. The Director may also prohibit any use of water for other than drinking and sanitation purposes. The prohibited uses shall be specified in the announcement of the public water emergency.
   (D)   Violations. Whoever violates an emergency use regulation is guilty of misconduct at an emergency and shall be prosecuted under §§ 648.06 and 202.99 of these codified ordinances.
