(A) Any person owning or occupying real property bordering on any street, upon which property there are trees, shall:
(1) Prune such trees in such a manner that they will not obstruct or shade street lights or obstruct the passage of pedestrians on sidewalks, the vision of traffic signs or the view of any street or alley intersection. The minimum clearance of any overhanging portion of such trees shall meet the requirements of the Shade Tree Commission;
(2) Treat or remove any tree or plant so diseased or insect-ridden as to constitute a hazard to trees or plants in public places;
(3) Remove and refrain from planting any of the species of trees prohibited by the Commission; and
(4) Obtain a permit for all required work as provided in this chapter.
(B) If any person owning real property bordering on any street fails to act as herein provided, the Commission shall order such person to prune, treat or remove such trees within ten days after receipt of a written notice to do so.
(C) When a person to whom an order is directed fails to comply with such order within the specified time, the city may take the action needed to solve the problem, and the exact cost thereof shall be assessed to the owner as provided by law in the case of special assessments. Such payments or assessments shall be paid into the Shade Tree Trust Fund and used solely for the purpose of enhancing the urban forest.
