(A) Whenever any public utility or other person finds it necessary to cut, open, excavate, tunnel, bore, surface, resurface or repair any street or park or operate any vehicle on the streets in connection with any work on the street or on the adjacent berm, a flag person shall be at the scene at all times to assist in the direction of traffic and protect the residents whether they are walking, bicycling or traveling by vehicle. Such flag person shall be trained in traffic control.
(B) In the event that the public utility or other person cannot furnish a flag person with the qualifications set forth in division (A) hereof, the Chief of Police shall furnish a qualified flag person.
(C) The compensation of the flag person shall be assumed by the public utility or other person performing the work and shall be paid directly to the flag person in the same manner and pay period as other employees on the project.
(D) Whenever workers are not actively engaged in performing work on any such project, there shall be adequate warning devices, barricades and lights placed around the site of the project so as to protect the public from injury. The placing and location of safety devices shall be under the direction of the Chief of Police or such other person designated by him or her to act as his or her agent.
