§ 818.01 OPERATION PROHIBITED; WAIVER.
   (A)   No person, firm, partnership, corporation or public body shall operate a dump, sanitary landfill, waste transfer station or recycling facility in the city.
   (B)   Notwithstanding any other provision contained herein, the City Council may waive the application of this section by separate resolution in any case where the Council finds that the operation of one of the above facilities would not constitute the operation of a public nuisance in the city. For purposes of determining whether said facility constitutes a nuisance, the Council shall consider the danger to the health or safety of the community, and whether or not the facility causes offensive noise, vibration, dust, heat, smoke, odor, glare or other objectionable influence to an extent substantially greater than that normally resulting from the conduct of other businesses within the city. The Council shall also determine whether or not the facility creates traffic substantially greater than that of other businesses in the city and whether or not such traffic can be controlled by reasonable means.
