§ 813.02 PROFIT BY OWNER OF PREMISES PROHIBITED.
   (A)   No person being the owner or lessee, or having custody, control or supervision of any premises, shall use or occupy any premises or portion thereof for the sale, transfer or distribution, whether done manually or through any mechanical or electronic device, of “Instant Bingo” tickets or similar items in which, in exchange for some consideration, a person receives a ticket or other item or the electronic or mechanical simulation thereof, that can reveal that the holder or player has won a prize in cash or otherwise, unless same is done in conjunction with a bingo game conducted by a duly authorized organization that has obtained a bingo license pursuant to Ohio R.C. 2915.08 and provided further that it is conducted only during the times as stated on the bingo license and not at any other time.
   (B)   This section shall not apply to the sale, transfer or distribution of any items by the Ohio Lottery Commission or its duly authorized agents pursuant to state law.
