(A) Pursuant to 47 C.F.R. § 76.938, the staff may require the production of proprietary information by the cable operator to make a rate determination and in such cases the staff will devise and apply procedures analogous to those set forth in 47 C.F.R. § 0.459 regarding requests for confidentiality. If no request for confidentiality is made, or if the staff denies a request for confidentiality, the information will be made available for public inspection pursuant to Ohio R.C. 149.43.
(B) A cable operator may appeal to the Council a denial by the staff of a request for confidentiality. The material which is subject to the request for confidentiality will not be made available for public inspection pending a Council decision on the request.
