SCHEDULE III. NO THROUGH TRUCK ZONES.
   (A)   Definitions.
      TRUCK. As used in this schedule and only in this schedule, shall be defined as:
         (a)   Every motor vehicle with three or more axles including any attached trailer; or
         (b)   Every motor vehicle designed or operated for the transportation of materials or property with a rated capacity over one ton (2,000 pounds).
   (B)   No through truck zones. The entire length of all of the following roads within the Town of Briny Breezes are hereby designated as "No Through Truck Zones":
      (1)   Old Ocean Boulevard.
      (2)   Cordova Avenue.
      (3)   Juniper Drive.
      (4)   Hibiscus Drive.
      (5)   Ruthmary Avenue.
      (6)   Cedar Drive.
      (7)   Bamboo Drive.
      (8)   West Cordova Avenue.
      (9)   Marina Drive.
      (10)   West Cedar Drive.
      (11)   West Bamboo Drive.
      (12)   Mallard Drive.
      (13)   North Ibis Drive.
      (14)   South Ibis Drive.
      (15)   North Heron Drive.
      (16)   South Heron Drive.
      (17)   Flamingo Drive.
      (18)   Lark Drive.
      (19)   Java Drive.
      (20)   Palm Drive.
      (21)   Dock Drive.
      (22)   Bay Drive.
      (23)   Eagle Drive.
      (24)   Cardinal Drive.
      (25)   Banyan Boulevard.
   (C)   Placement of traffic control devices. Appropriate signs designating the "No Through Truck Zones" shall be erected at or near the roadways which are subject to this section as directed by the Town Marshal or by resolution of the Town Council. The signs may use pictures or words or any combination thereof, to provide reasonable notification of the existence and location of "No Through Truck Zones." Examples, without limitation: "NO THRU TRUCKS" and/or "NO VEHICLES THREE OR MORE AXLES."
   (D)   Prohibitions. It shall be unlawful for any truck, as defined in this schedule, to travel on any road marked with a traffic control device (sign) designating the road as a "No Through Truck Zone" unless excepted under division (E).
   (E)   Exceptions.
      (1)   Restrictions set forth in this schedule shall not apply to any of the following vehicles:
         (a)   Any vehicle whose destination is within a "No Through Truck Zone” for the benefit of, or at the request of, a resident or owner within the "No Through Truck Zone."
         (b)   Utility service vehicles providing services to residents or owners within a "No Through Truck Zone."
         (c)   Utility service vehicles servicing equipment located within a "No Through Truck Zone."
         (d)   Public service vehicles.
         (e)   Emergency service vehicles.
         (f)   Vehicles for the delivery and set up of a mobile or manufactured home.
         (g)   Construction related delivery or equipment activities when a permit has been issued by the Building Official for said construction within a "No Through Truck Zone."
         (h)   Construction related delivery or equipment activities of the town.
         (i)   As may be necessary or advisable for the performance of any governmental use or service within the town during any emergency duly declared by Town Council resolution or pursuant to the statutory or constitutional powers of a Florida State public official or a Federal Government public official.
      (2)   Any person driving or in charge of a truck within a "No Through Truck Zone," as those terms are defined in this schedule, shall be prepared to present for the inspection of police officers the truck’s log book, weight slip or placard, delivery slips, or other written evidence of the truck's origin, rated capacity, and destination to justify their presence in a "No Through Truck Zone" or the application of any exception stated in this schedule.
   (F)   Penalty. The Town Marshal shall enforce the provisions of this schedule. A violation of this schedule is a noncriminal traffic infraction, punishable as a moving violation as provided in F.S. Chapter 318, as the same may be amended.
