§ 31.02 TOWN CLERK.
   (A)   The Town Council finds that the facts contained in the preamble of the ordinance codified herein are true and correct and they are incorporated herein by reference as legislative findings of fact.
   (B)   The salary and benefits for the office of Town Clerk, together with the manner of payment, shall be set by resolution of the Town Council.
   (C)   The Town Council is authorized to appoint a Town Clerk Pro Tem whenever a vacancy occurs in the office of Town Clerk. The Town Clerk Pro Tem so appointed shall serve for the remainder of the term of the vacant office until the next regular election, or until a subsequent vacancy in said office occurs by reason of the resignation or the inability of the appointee to continue to so serve in such capacity. Upon appointment, the Town Clerk Pro Tem shall fulfill and perform all the duties and obligations of the office of Town Clerk, and shall be entitled to receive the emoluments of office fixed for the office of Town Clerk.
   (D)   The duties and responsibilities of the office of Town Clerk shall include the following:
      (1)   To serve as Clerk of the Town Council and perform such clerical and business services of the town according to the duties and obligations of said position as required by law;
      (2)   To keep the records of the Council and be responsible for the recording, filing, indexing and safekeeping of all proceedings of the Council and the other boards, commissions and agencies of the town;
      (3)   To maintain the books, records and financial accounts of the town as the town’s bookkeeper;
      (4)   To prepare estimates of revenue and expenditures and give other assistance in the preparation of the town’s annual budgets;
      (5)   To be in attendance as the Clerk at all Council meetings and to maintain an accurate journal of al Council proceedings;
      (6)   To prepare the agenda for Council meetings under the supervision and direction of the Town Council;
      (7)   To arrange for the publication of all ordinances, resolutions, public notices an all other documents required to be published by law or by the direction of the Town Council;
      (8)   To be the custodian of all contracts, deeds, ordinances, resolutions, journals, records and documents of the town and to keep and maintain a current and accurate record thereof;
      (9)   To be responsible for and assist in the codification of the code or ordinances of the town;
      (10)   To be the registrar of electors and responsible for the orderly and efficient conduct of the town elections; and
      (11)   To perform such other duties which are assigned by the Town Council.
   (E)   Whenever necessary for the timely and efficient operation of the town business and affairs, the Town Council is authorized to appoint one or more Deputy Town Clerks to assist the Town Clerk or Town Clerk Pro Tem in the performance of the duties and obligations of the office, and to provide the means and manner for compensation of appointees to the position of Deputy Town Clerk.
   (F)   The Town Council shall appropriate sufficient funds in the annual budget to defray the costs and expense necessarily incurred by the Town Clerk in providing the aforesaid clerical and business services to the town.
   (G)   This section shall take effect on October 23, 2008.
