§ 112.15 DEFINITIONS.
   For the purpose of this subchapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
   APPLICANT. Any person applying for a liquor license, as provided for herein, including all persons in a partnership, and all persons who are the officers or stockholders owning more than 5% interest in a corporation.
   BEVERAGE ALCOHOL or INTOXICATING LIQUOR. Any spirits, wine, beer, ale, or other liquid containing more than 0.5% of alcohol by volume which is fit for beverage purposes.
   MINOR. Any person under the age of 21 years.
   PACKAGE LIQUOR STORE. Any establishment maintained, advertised, and held out to the public as a place where beverage alcohol or intoxicating liquor is sold for the use or consumption at a place other than the establishment.
   RESTAURANT. A public place kept, used, maintained, advertised, and held out to the public as a place where meals are actually and regularly served, such place being provided with adequate and sanitary kitchen and dining room equipment, and having employed therein a sufficient number of employees to prepare, cook, and serve suitable food for its guests and in which beverage alcohol or intoxicating liquor is sold for use or consumption on the premises. In addition, any business claiming to be a RESTAURANT must document, upon demand, that 50% or more of its gross receipts is derived from the sale of food as distinguished from alcoholic liquor.
   RETAIL SALE. The sale for use or consumption and not for resale.
   SOCIAL EVENTS. All events, including homecomings, wedding receptions, and social parties in which alcoholic liquors are either sold or served for use or consumption on the premises.
   TAVERN. Any establishment maintained, advertised, and held out to the public as a place where beverage alcohol or intoxicating liquor is sold for use or consumption on the premises.
